These Terms and Conditions govern your relationship with Gourmet at home Ltd (a company registered in England with company number 12566813 and whose registered office is at 10 Brondesbury Road, Greater London, England, NW6 6AS, “Gourmet at home”, “we”, “our” or “us”) and all orders that you may make for the food and Products advertised for sale by us (the “Products”) via the Gourmet at home Website, www.gourmetathome.co.uk (the “Website”).
By using this site, you signify your acceptance of these conditions in return for which we will provide you with access. From time to time we may modify the conditions so please continue to review the conditions of use whenever accessing or using this site. If at any time you do not wish to accept these conditions then you may not use this site.
3. Availability of the Website
3.1. Although Gourmet at home aims to offer you the best service possible, we make no promise that our Website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us and we will correct the fault as soon as we reasonably can.
3.2. Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. In the event that our Website is unavailable, our usual order and cancellation deadlines apply; please notify us of changes to your order via email (orders@gourmetathome.co.uk)
The content of the Website, software, photographs, illustrations, artwork, names, logos, marks, formats, database are protected by copyright, trademarks and other rights of intellectual property owned by us or licensed to us. Anyone accessing this site is entitled to view any part of it. However, the Content must not be used nor reproduced (in whole or part) for any other purpose including on or in connection with another website or publication or for direct commercial gain without written permission from Gourmet at home Ltd.
5. Limitation of liability
We accept no liability for functions contained on the site and make no warranty that the site will operate uninterrupted or error-free or that any defect will be corrected. We do not warrant that the site is compatible with your computer equipment or that the site or its server is free of errors or viruses and we shall not be liable for any damage you may suffer as a result of such destructive features. You acknowledge that your use of this site and its content is at your own risk.
6. Applicable law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
7. Registration
7.1. To order from Gourmet at home, you must register with us.
7.2. This is referred to as ‘create an account’ throughout our Website and;
7.3. However, this is not a credit account; payment will be required at the checkout stage.
7.4. This account can be set up by following the instructions on the Website:
7.4.1. To register with Gourmet at home you must be over eighteen years of age or, if you are a business, you must be operated by a person over eighteen years of age.
7.4.2. You must ensure that the details provided by you on registration or at any time are correct and complete.
7.4.3. You must inform us promptly of any changes to the information that you provided when registering by updating your personal details.
7.4.4. The personal and payment details you give to us are governed by a strict privacy policy please see the separate document by www.gourmetathome.co.uk/privacy.
7.4.5. Following your set up of an account, we will email confirmation of your account set up to you.

8. Password and security
9.1. When you register to use the Website you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting us immediately. We would also suggest that you also change your password immediately through the My account – change password section of the Website.
9.2. If Gourmet at home has reason to believe that there is likely to be a breach of security or misuse of the Gourmet at home Website, we may require you to change your password or we may suspend or cancel your account.
9.3. The auto login facility is provided for your convenience. If you enable it, you remain liable for all activities and orders which are submitted to your account. You should therefore only enable auto login on your machine if you are sure that it will not be misused by anybody else. We do not advise enabling auto login if you use a shared computer.
9. Orders & Stock
Orders can be placed at any time on our website (www.gourmetathome.co.uk).
The online ordering facility on the Website allows you to review your order and make any corrections before submitting it to us and by submitting the order you confirm that you have made any such corrections.
Each Product for which you click ‘Add to basket’ is added to a ‘shopping basket’ facility. You are given the opportunity to review your shopping basket. You can change these, or cancel the purchase of each of the Products completely, at this stage, at any time before clicking ‘Checkout’. After you have clicked ‘Checkout’ and after our acceptance of your order, items are added to your delivery in addition to any items that you have previously selected.
No order is accepted from you until our Website displays an order confirmation message.
Stock levels displayed on the website are to be treated as a guide only although we will do our best to keep them accurate. If we are unable to deliver an item you have ordered, we may offer a reasonable substitute. You may reject that substitute and we will credit the amount you paid for the item onto your account. If we do not offer a substitute, we will remove the Product from your order and we will credit the amount you paid for the item onto your account. We will, however, bear no liability for unavailability of Products.
Registered customers must comply with a minimum order value of £60 including VAT and shipping.
10. Products & Prices
All Products offered by us are subject to seasonal changes in supply levels and supply prices.
Due to its nature, some of our products have variable weights, our prices are per unit showed in the product description and the weight of the item should stay within the weight range described (for example, meat Products).
Despite our best efforts to keep product information up to date on the website, the appearance of items may change from time to time. Therefore, please consider product photos as a guide to their appearance rather than a definitive representation of how the product you order will look. If the visual properties of any particular product are of particular importance to you, please contact us before ordering.
Although we make every effort to keep product information up to date on the website, we may from time to time have to source products from different suppliers in order to ensure a consistent supply. We therefore reserve the right, where the brand specified or depicted on the website is not available, to substitute for a similar brand.
We sell only to end users and our Products are not for re-sale. You warrant that you shall not re-sell any of the Products.
All prices for Products are quoted in GBP (£) and are inclusive of any applicable VAT.
Prices and charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation.
11. Payments
11.1. Payment for all Products must be by credit or debit cards.
11.2. No handling or administration fees will be charged.
11.3. You can make changes to your payment details by updating them in the ‘My account’ section of the Website or by calling us via the contact details on the Website.
12. Deliveries
We will make delivery to your address as stated when you set up an account or update that address. We reserve the right not to deliver to all locations and we will tell you when you apply to register an account with us whether we can deliver to your address. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions.
Delivery will only take place during normal office hours and unless otherwise specified, yourself or an authorised person will need to be present to accept the delivery. Please contact us before ordering if you know that you or an authorised person will not be present to accept delivery during the day and we will do our best to find a suitable delivery arrangement. Please note that we cannot offer guaranteed times deliveries.
If per leaving your goods unattended outside your property and in the event that your delivery is stolen or damaged while there, we do not accept liability, although we may consider offering compensation at our own discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. Any changes to address details must be made before the order has been placed.
If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown or traffic congestion, we cannot accept liability for any inconvenience or loss that this causes.
You must inspect the Products as soon as possible after delivery and notify us promptly if you find any defects, by calling us, emailing us or writing to us at the telephone number or address shown on our Website. We will replace or refund you for defective Products.
Deliveries can be made via third-party courier or Royal Mail postal services. Under normal circumstances, UK Mainland courier deliveries are made on the day following despatch, but this is not a guaranteed service and we cannot accept liability for losses or damages incurred due to delayed delivery where either the courier or any other party is at fault. Please allow up to seven working days for delivery.
If you need your goods before a specific date, please allow plenty of time for ordering, despatch and delivery.
We have clearly specified that it is preferable for somebody to be present at the delivery address in order for the courier to obtain a signature. However, where the customer instructs us to instruct the courier to leave their package in a particular location, we will comply. In such cases, we are unable to entertain claims for non-delivery where the courier’s records show that the package was left in the specified location.
13. Excluded services
It is your responsibility, at your cost, to obtain computer, internet connectivity, telecommunications or other necessary equipment or services to access the Website.
14. Cancelation rights
In the case of non-perishable Products only, our customers have the statutory right to cancel the order and contract within 48 hours of receipt. In addition, you will be liable for the cost of returning the goods to us. Please note that this will apply if you should decide to cancel due to delayed delivery (where delivery has taken or will take less than 5 working days).
To exercise the right to cancel, you must inform us of your decision by a clear statement, by email and within the 48 hours of purchase.
When returning goods, please ensure they are packaged well, either in the original packaging or a suitable alternative. We cannot be held responsible for any breakages or damages that occur whilst the goods are in transit back to us.
In the case you receive a faulty product, normally, we’ll just ask for a quick photo of the defect to be sent to orders@gourmetathome.co.uk then we will decide if we will need a return at our own costs and offer a replacement for the item.
15. Amendments to the Terms
We may update these Terms and Conditions from time to time. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms and Conditions.
